I am so annoyed with everything right now. I just need to rant.
I gave my landlord 90 days notice that I would not be renewing my lease, sent her written notification, a text message, and told her verbally. 14 days before my lease was up she called me to tell me she was reviewing my lease and if I was moving out July 31st, then I was breaking my lease early because it wasn't up until AUGUST 31st. How is that even possible? And why the fuck didn't you let me know sooner, like when I gave you notice clearly stating I would be vacating on the 31st? I moved in on August 1st and signed a 12 month lease.
I then realized I didn't even have a copy of my lease. I did have a receipt for my security deposit which even said 12 MONTH LEASE. I also have a receipt for the first month's rent, which said August 1st-31st. She said that August was indeed my first month, but no matter what day of the month you move in, even if it's on the 1st, your lease doesn't end until the 31st by state law. Wtf? That's a contradiction because that is 13 months when I clearly signed a 12 month lease. So I asked her if I could come view my lease because I didn't believe her. Conveniently she was on vacation and wouldn't be able to be there until AFTER my next month's rent was due. I told her there was no way I was paying an extra month, I already signed a new lease somewhere else starting on August 1st so I'd have to pay double rent, I gave her 90 days notice, it was a 12 month lease.. hell no. She said she might be able to find someone to move in early and in that case she wouldn't charge me the full moth, even if that didn't work out she would work something out with me, not to worry, etc.
So then I moved out, and went back on August 3rd, the day she told me she'd be in the office from 9-12. I even sent her a text message on the 1st to remind her. She wasn't there. I tried to call her.. no answer. Ran some errands and came back.. not there. Never was there. So I left my keys in her box and said fuck it. I left her a message telling her I was done, just to keep my security deposit (which is the same amount as a month's rent) and we'll call it a day. This is a huge sacrifice for me because my apartment was in pristine condition, it was probably 10 times cleaner when I moved out than the day I moved in. Not a stain on the carpet, the stove pans were perfectly clean, not even a hole or a dent in the wall besides where my curtains were hanging. But I just wanted to be done with her, she was nothing but a bitch for the entire year, it took her weeks to get to maintenance requests (important ones too) and the place in general just sucked so it was worth it to just be done.
She called me back a day later, so sorry she wasn't in the office, something came up, etc. She cannot use my security deposit to cover my last month's rent because it breaks "state law." She will have to do a walk through, etc. I will still have to pay August rent because she hasn't found anyone to move in. So I threw it right back at her with this whole state law bull shit.. state law says the walk through must be done within 5 days of the tenant vacating.. today is day 5. State law says I must be present for that. State law says you are to provide all tenants with a copy of the lease.. I've asked you for that 5 times and have never seen it. Her response? "Are you getting smart with me?"
Anyway, I think she realized she wasn't going to win and get any more money out of me, so she told me to "relax", that she would work something out, she would use my security deposit for my (imaginary) last month's rent, and if she found someone to move in she would even prorate it and send me some money back, and send me a bill for my "damages". She reminded me that state law prohibits this, and also that she has 45 days to return my security deposit, just so I know, that she's doing me a huge favor. I told her thanks, there wouldn't be any damages, and have a great life. I've driven by there several times to see if somebody moved in. They did. On the 17th, so according to what she told me she would only charge me through the 17th and I would still receive money back from my deposit. (Yeah right)
So I just received a letter in the mail dated August 20th. The letter says I FORFEITED my security deposit because I moved out early (she never once mentioned that was even an option, she made it seem like no matter what I'd get my security deposit back) and still owe her the month's rent PLUS 5 months of water bills... I have paid her every single ONE of those water bills. I have never been late on rent or a water bill. She said she might have to take me to court if I don't pay these "in a timely fashion." Wtf?
I'm pretty sure my head is going to explode. Now it very well may say somewhere in my lease that I forfeit my security deposit by moving out early.. but why the fuck wouldn't she have mentioned that to me already? Also I STILL do not have a copy of my lease.. also I was not present for any type of walk through. What am I supposed to do here? I just tried to call her.. no answer. I'm going to lose it.
