I think if someone is thinking, drawing and reading about children in sexual situations deep down they may want to act on that fantasy.

In that same vein, women (and men) fantasize about rough sex and maybe even rape. Rape is a crime as well.

Sometimes you read and imagine stuff so much it can translate into real desires that need to be fulfilled. That's when it gets hairy for me. Someone will read this stuff and attempt to harm a child.

These are key words here. Sure it CAN translate into a real desire and someone MAY act on it, but we have no idea whether or not it will happen or who it will happen to.

This isn't Minority report. We can't lock people up for things that they MIGHT do at a later date.
