If someone says they do not want to be around it then the person smoking should consider that and go outside and finish smoking. i am allergic to cigarette
smoke and earlier tonight my fiance and i had some friend's over. his friend lights up a cigarette and my fiance and i both ask him to please go outside.
he refused so i went outside. when i came back in the friend was leaving but still, he could have respected what i asked and went outside. it's my
apartment just as much as it's my fiance's right?

I would never allow my fiance to have that person over again. You do not disrespect me in my own place.

I think you should be able to kill people that smoke next to you and claim self defense.

He refused to go outside when you asked him to? Wow...that's not cool. I would not invite that person over anymore. That's really disrespectful.

And after he refused you allowed him to stay? I would have been like "that's cool....well I guess you'll be getting the fuck out now..."

Smokers are not allowed in my apartment or my car. Because smokers smell like dog shit.

That is extremely rude, not to mention wrong of him. I would have kicked his ass out and would never invite him back over again. He sounds like a real jerk.
A few weeks ago my mom's friend came over and kept going out onto our front steps to smoke and I finally had to ask her to walk down toward the street because the smoke was blowing right back into the house through the windows and under the door which was just plain nasty |

If someone lit a cigarette in my home, I would ask him to leave.
