Only reason she was forced to stop and refund the money from the pre-orders is because she was breaking ebay's TOS (if you allow pre-ordering, the item must be shippable within "x" amount of time from when you start taking the pre-orders, or something like that).

If I understand things correctly (which I might not be) it'll be another 10 years before her works fall into public domain unless whoever manages her estate is able to renew/retain the rights to it.
