Britney Spears Sued Posted May 29th 2009 3:00PM by TMZ Staff Britney Spears is being sued by the photog who got run over ... and we got the whole thing on tape. Rick Mendoza was a casualty of Britney's Mercedes as she was pulling out of a Beverly Hills parking structure in 2007. In his lawsuit, Mendoza says Britney's people -- who are also defendants -- "should have known...Britney was not in the mental, emotional and/or physical condition to operate the subject motor vehicle in a safe and reasonable manner." She ran over his foot ... and it did look painful. FOOTnote: TMZ auctioned off his sock.

She wasn't under conservatorship then, she was a private citizen/adult and when a private citizen gets behind the wheel of a car it's their responsibility to make sure they're fit to drive. I see no legal basis for holding them responsible. As for the one against her... I'd like to say that since he was the cause of his own mischief (I mean, wow, why should the idiot have known that if you're dumb enough to step in front of a moving vehicle that you might get run over, right?) that the claim would get quickly dismissed, but then we are talking about a world in which you can successfully sue McDonald's for the fact that your coffee was hot.
