No, above the signature it says "By signing this you agree it's true...etc" so I went ahead and signed it but it has to be notarized so I
didn't know if I had to wait and sign that in front of them.

Yeah, I'm a notary too.....it has to be signed in my presence otherwise I won't notarize it.

Well, not all notarys follow the rules -- but the are SUPPOSED to make sure you sign it in their presence -- that is the entire point -- otherwise it could
have been forged beforehand. The notary you used that notarized something you signed earlier could lose his or her seal for that if they were caught. I'm
pretty sure they could even face legal penalties for violating their job as a clerk of the court.

In my notary handbook it says a document can be signed before being brought to a notary, however the person who signed must be present with a current picture
id.

You can take the person's acknowledgment that he was the one who signed the document (See Short Form #2); however, the person must appear before you to swear that he is the signer and you must still verify his identity. This cannot be done by phone, fax, or comparison of signatures - ever.

Just out of curiousity - how did you guys get to become notaries? Do you have to take a class? Or what? Is it hard to learn?

I filled out the paperwork and went down to the local insurance office and got bonded. Sent in the bond, application and $25 fee and I had my notary papers in
2 weeks. Then I ordered a notary seal from the local office supply store. Very simple. Costs maybe $50 total and is good for 4 years here in MT.
