Travis Barker is suing Bombardier Inc., Clay Lacy Aviation and Goodyear Tire and Rubber in connection with the plane crash that severely injured him and killed two of his friends.
The suit, filed in L.A. County Superior Court, was filed by Barker and the mother of Charles "Che" Still, Travis' bodyguard who died in the crash.
In the lawsuit, Travis and Thelma Martin Still claim "one or more of the tires failed leaving tire debris and portions of airplane components along the 8,600 foot runway" ultimately causing the Learjet to crash.
The suit alleges a "negligent attempt to abort the takeoff." The suit continues, "The pilot's decision was a breach of their duty owed to the passengers onboard and was a substantial factor in causing the crash and resultant injuries and deaths."
The suit also alleges the plane was "defective," as were component parts including the tires.
The suit goes on, "It's landing gear, tires, wheels, brakes, reverse thrust system, squat switches and component parts were not airworthy."
Barker is suing for "pain and suffering, mental anguish, psychological and emotional distress and disfigurement and pre-impact fear of death and burning."
UPDATE: A rep for Clay Lacy just told TMZ, "We are surprised about the lawsuit and concerned and knowledgeable about the accident. We are sympathetic for the victims but we want to emphasize we were not operating this airplane. This was not our airplane. We merely assisted the parties in chartering this aircraft with another company. We simply booked it for them."

I'm a little iffy on the suing personally. I mean when you look at statistics it's a very rare occurence, and as frightening and saddening it was it
was an accident. And accidents happen.

Okay I know he's upset (and understandably so) and probably has to place blame on someone but don't blame the freaking pilot. He died in the crash too.

Why is he suing on the grounds that the pilot made a poor decision upon take off? The pilot is dead. I get that he wants someone to blame, but IDK how I feel
about this lawsuit. Also, you can't blame the people who booked the aircraft on your behalf due to your request.

I hear the settlement they're asking for is a low-ball figure, most likely they will settle without a trialits all about the money.... I think the onslaught of over the top lawsuits have made Americans cynical about lawsuits in general, even the ones which are merited Take the example of the hot-coffee lawsuit, the woman in question sued McD's for her medical bills but they refused. Only after more complaints came up because of how they prepared their coffee that she got a settlement |

I think he's angry that his friend died, I think he's pissed off that he had to go through that, and I think he wants to point the finger at someone
because he doesn't feel like the situation is justified. He doesn't understand why it happened to him and he wants someone to be like, "it was my
fault".

I wish more people would sue the plane companies. I agree suing the pilot is wrong. But somebody needs to make these companies more cautious about what planes
they fly. You would not believe how many planes actually crash. I was not aware of it until my niece died in one in june. Just in a span of 2 months after her
crash, 3 more planes crashed just from her same flying agency. We did not sue, but I feel like somebody needs to make this companies pay for what they do. My
uncle works for a big plane company, I will not name names. His job is to look at the planes, find what is wrong with them and fix them. Even he says he will
not fly this companies planes. Because they will find a problem with it, but the company will say they do not have the money or time to fix it, and they will
fly innocent people on it anyway. These companies are just out to get our money, they honestly could not care less about our safety. They gamble with it all
the time.
