Waiters make about $2.15/hour, so if they're not getting their tips, they're not making any money. I'd sue too, if I had the opportunity. It's true that Justin probably has no idea about the day-to-day operations of his restaurant, but as the owner, he's responsible for what happens there regardless. I'm sure if he were made aware of the situation (which is likely now that he's being sued...) he'll want to settle out of court and fix whatever the issue is in the first place. Justin doesn't seem like the type of celebrity who starts a business and then stops giving a shit about what gets done in his name.

Im sure the people hired to run the restaurant are experienced professionals in the local restaurant biz, and used the same practices at S.H. as at other
restaurants in NY. Probably standard practice but technically illegal in some way or else not too hard to argue that it is by some unscrupulous plantiffs'
attorney.
But these celeb owners get sued because theyre rich enough the plaintiffs (and their lawyers) can actually collect!! Normally theyd have to sue some hardworking restaurant owner who makes a normal income -- they could sue for whatever they wanted but the money wouldnt be there to pay them -- the plaintiffs would be lucky if there was anything left over for them once their lawers got paid. Here they can try to make Justin liable for everyone else, even though he had no part of it, and collect from him. |

The plaintiff also says that he regularly worked more than 40 hours a week and received no overtime pay. Restaurant manager Chris Russell said that staffers took home every bit of their tips and that employee salaries were well over minimum wage. Reps for Timberlake or his partners have yet to respond to the suit. So it's an ex employee sueing. It's probably baseless. This kind of crap happens all the time. |

I will just say that working at restaurants sucks a lot. You usually don't get to take the federally-mandated breaks (including 30 minute lunch) because
your breaks are dependent upon how busy the restaurant is. I lasted about .0007 seconds waiting tables because it's hard and way too much work for not that
much money.
Anyway, if the guy worked overtime and didn't get paid for it, that's illegal. But if what really happened was, he had to work through his breaks because the place was busy, then he shouldn't have gotten paid for overtime. The managers need to make sure people get their breaks, though. It's hard to say who's at fault when we don't know the whole story. |

That sucks for the workers being cheated like that. I'd sue too. These tips are all that the servers have to depend on. I've never been a server but I
see what they go through. It's not easy to do so much and be paid so little.
