Specifically Section 1 (26. U.S.C. 1) states "There is hereby imposed on the taxable income of every individual who is not married a tax determined by the following table..." Married people have a different tax table to go by but their income is legally taxable as well. The argument that it is not law have been thrown out of courts as frivolous and spurious. Every "there's no income tax law" has been refuted including those who say it is voluntary. If you don't want to pay taxes, fine. Just don't use things that were built and operated with tax dollars.

Also fuel tax is not the primary source for transportation funding.

I personally wouldn't not pay though because I don't want to deal with the IRS.
